Dark Elves/Drow Lore -- limitations?

Trying to figure out what is off limits when it comes to the lore of dark elves, such as Lloth/Lolth and Eilistraee, their history, conflict etc. Are these things off limits for original fiction entirely? It might be a dumb question, but I am just trying to figure out what I can use or if I need to completely modify things (i.e. change names, make up own lore, etc.) to avoid any law breaking. Thanks!

Different people have done different things with Dark Elves. Feist, in his 'Magician' series, made them an aggressive race of forest dwellers. Tad Williams, in his 'Memory, Sorrow and Throne' series (at least that's how I think of them) had his dark elves dwell in a frozen mountain in the far north. Mythologically, the 'Dock Alfar' were no worse behaved than some of the other fey beings running around.
