Buyjupiter, as long as the name and appearance don't match, there is no base for a lawsuit. Don't make the name similar, and make their appearance absolutely different. For example, if the original guy is tall and lanky, make the character short and overweight. If the original is a Scott and has red hair, make the character an African-American with black fuzz on his head, and so on. Although the speech pattern should be different. You should be OK.
